NiveshKaro.com ("NiveshKaro", "we", "us", or "our") operates as a free, zero-commission intermediary platform that connects users with independent, certified local financial advisors, consultants, or agents ("Advisors") in India, providing general, non-binding educational content about financial products and services (e.g., life/health/motor insurance, mutual funds, tax filing, government schemes like PPF/SSY). This Take Down Policy outlines our procedures for addressing complaints regarding alleged copyright infringement or unlawful content on the NiveshKaro website, its subdomains, mobile applications, and all related services (collectively, the "Platform").

NiveshKaro complies with the Digital Personal Data Protection Act, 2023 (DPDP Act), Information Technology Act, 2000 (IT Act), and Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, qualifying for safe harbour protection under Section 79 of the IT Act as an intermediary. This policy is designed to protect NiveshKaro, its affiliates, directors, officers, employees, agents, and licensors ("NiveshKaro Parties") from liability while respecting the legitimate rights of copyright owners and ensuring compliance with Indian laws

Response Timeline: NiveshKaro reserves the right to provide an initial response to any emails, inquiries, or supports within 21 working days. This period may be extended to 180 working days at our sole discretion, and users agree to wait for the response within this timeframe.

1. Purpose of the Take Down Policy

NiveshKaro is committed to preventing users from being misguided while exploring financial products or services. We respect the intellectual property rights of copyright owners and have adopted an efficient notice and takedown procedure to address complaints regarding alleged copyright infringement or unlawful content on the Platform, in compliance with the Copyright Act, 1957, IT Act, and IT Rules 2021.

2. Content on the Platform

NiveshKaro hosts various videos, articles, circulars, notifications, and other financial, insurance, or investment-related information on the Platform. This content is sourced from public domains, freely available websites, YouTube, or other social and digital platforms, where it is uploaded by owners with the intent of further dissemination. NiveshKaro does not claim any copyrights over such content and uses it solely for non-commercial, educational purposes to inform users. We exercise due diligence as an intermediary under Section 79 of the IT Act to ensure compliance with applicable laws.

3. Notice and Takedown Procedure

If you believe that any content on the Platform infringes your copyright or is unlawful, you may submit a written complaint to our Support Officer. Your complaint must include:

  • Identification of Content: A detailed description of the allegedly infringing or unlawful content, including its location (e.g., URL, page, or section).
  • Evidence of Rights: Proof of your ownership of the copyright or legal rights over the content.
  • Statement of Infringement: A signed statement confirming that you believe in good faith that the content infringes your rights or is unlawful under Indian law.
  • Contact Details: Your name, address, email, and phone number.
  • Declaration: A declaration that the information provided is accurate and that you are the copyright owner or authorized to act on their behalf.

Submit complaints to: support@niveshkaro.com or write to Mrs. Reshma Chavan, Support Officer, at the address above.

Upon receiving a valid complaint, NiveshKaro will:

  • Acknowledge receipt within 21 working days (extendable to 180 working days).
  • Investigate the complaint and, if warranted, remove or disable access to the content within 36 hours, as per IT Rules 2021.
  • Notify the content uploader (if applicable) and provide an opportunity to respond, as required by law.
4. Counter-Notification

If you believe content was wrongly removed, you may submit a counter-notification to support@niveshkaro.com including:

  • Identification of the removed content and its location.
  • A statement under penalty of perjury that the content was removed in error.
  • Your contact details and consent to the jurisdiction of courts in Thane, Maharashtra.
5. Right to Erasure (Forget Me)

If you have submitted personal data to the Platform and wish to have it deleted, email team@niveshkaro.com with the subject line “Forget Me.” We will delete your data within 72 hours, subject to legal retention requirements. Requests may be responded to within 21 working days, extendable to 180 working days at our discretion.

6. No Liability for Third-Party Actions

NiveshKaro Parties shall not be liable for any damages arising from the presence or removal of content, actions of Advisors, or reliance on Platform content. As an intermediary, NiveshKaro is not liable unless it fails to act upon actual knowledge of illegality, as per Section 79 of the IT Act.

7. Modifications to Take Down Policy

NiveshKaro reserves the right to modify or update this Take Down Policy at any time. Continued use of the Platform after changes constitutes acceptance.

8. Governing Law and Jurisdiction

This Take Down Policy is governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in Thane, Maharashtra.
