This Advisory for Investors ("Advisory") serves as a precautionary guide for users ("you" or "Investors") who engage with Advisors or third-party financial institutions through the NiveshKaro website, its subdomains, mobile applications, and all related services (collectively, the "Platform").

This Advisory is intended to help you make informed decisions, exercise caution in financial transactions, and understand the refund and claim settlement processes. By accessing or using the Platform, you agree to follow this Advisory and all other policies, including the Terms and Conditions, Privacy Policy, Disclaimer, and Take Down Policy (collectively, the "Policies"). NiveshKaro complies with the Digital Personal Data Protection Act, 2023 (DPDP Act), Information Technology Act, 2000 (IT Act), and Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, qualifying for safe harbour protection under Section 79 of the IT Act as an intermediary.

1. Purpose of the Advisory

This Advisory provides precautionary guidance to protect your interests when engaging with Advisors or third-party financial institutions (e.g., insurers, asset management companies) connected through the Platform. It also outlines the processes for refunds and claim settlements. NiveshKaro is not an insurance company, broker, aggregator, investment advisor, stock broker, tax consultant, or agent under regulations such as the Insurance Regulatory and Development Authority of India (IRDAI), Securities and Exchange Board of India (SEBI), or the Income Tax Act. Our role is limited to facilitating connections between you and Advisors and providing general, non-binding educational content for informational purposes only.

2. Your Responsibilities as an Investor

As an Investor using the Platform, you are solely responsible for:

  • Verifying Advisor Credentials: Confirm the qualifications, licenses (e.g., IRDAI license for insurance agents, SEBI registration for investment advisors), and authenticity of Advisors before engaging their services. Request and review valid documentation, such as registration certificates or professional affiliations.
  • Conducting Due Diligence: Independently research and verify the terms, risks, and suitability of any financial product or service (e.g., insurance policies, mutual funds, government schemes) before making decisions. Consult licensed professionals if needed.
  • Secure Payment Practices: Make payments only through official, regulated payment channels of the respective financial institution (e.g., insurer or AMC portals). Do not pay cash or transfer funds directly to Advisors or any individuals. Verify payment links and avoid sharing sensitive financial details (e.g., bank account numbers, OTPs) unless through secure, authorized platforms.
  • Understanding Risks: Recognize that all financial products and investments carry inherent risks, including potential loss of capital. NiveshKaro does not guarantee returns, pricing, or outcomes of any product or service.
  • Reviewing Documentation: Carefully read and understand all terms, conditions, and disclosures provided by Advisors or financial institutions before entering into agreements or transactions.
  • Complying with Laws: Adhere to applicable laws, including Know Your Customer (KYC) and Anti-Money Laundering (AML) requirements under the Prevention of Money Laundering Act, 2002.
3. Role of NiveshKaro

NiveshKaro’s role is limited to:

  • Matching you with Advisors based on your geographic location and financial needs, without guaranteeing availability or suitability.
  • Providing general, non-binding educational content sourced from public domains or third-party providers.
  • Offering limited or no assistance with query submission or form completion, without underwriting, approving, or processing applications.

NiveshKaro does not provide personalized financial, investment, tax, or legal advice and is not responsible for the actions, advice, or services of Advisors or third-party providers. Advisors are independent professionals, not employees, agents, or affiliates of NiveshKaro.

4. Precautions for Safe Engagement

To protect your interests, we strongly recommend:

  • Verifying Advisor Legitimacy: Confirm the Advisor’s registration with relevant regulatory bodies (e.g., IRDAI for insurance, SEBI for investments, ICAI for tax consultants) and check for any disciplinary history.
  • Avoiding High-Pressure Tactics: Be cautious of Advisors who pressure you into quick decisions or investments without adequate disclosure.
  • Securing Personal Information: Do not share sensitive personal or financial information (e.g., Aadhaar, PAN, bank details) unless through secure, verified channels. Report any suspicious requests to support@niveshkaro.com.
  • Seeking Independent Advice: Consult multiple sources or professionals to validate advice or product recommendations before committing.
  • Monitoring Transactions: Regularly review your financial accounts and transaction confirmations to detect unauthorized activity early.
  • Reporting Issues Promptly: If you encounter issues with an Advisor or provider, contact them directly and, if necessary, escalate to regulatory authorities (e.g., IRDAI, SEBI, RBI). You may also inform NiveshKaro at support@niveshkaro.com for limited assistance, subject to our response timeline.
5. Refund Process

If you are dissatisfied with the services or products provided by an Advisor, insurance company, investment company, or other third-party provider connected through the Platform, you must:

  • Contact the Provider Directly: Email the insurance or investment company using the contact details provided in their payment confirmation email or official documentation. Refunds will be processed solely by the third-party provider in accordance with their respective refund policies.
  • Follow Provider Procedures: Comply with the refund requirements of the insurance or investment company, which may include submitting specific documentation or adhering to their timelines.
  • Optional Assistance from NiveshKaro: While NiveshKaro is not obligated to intervene, we may, at our discretion, assist in forwarding your refund request to the relevant provider. To request assistance, contact us at support@niveshkaro.com with details of your issue, including the provider’s name, transaction details, and supporting documentation. NiveshKaro reserves the right to respond within 21 working days, extendable to 180 working days at our discretion.

NiveshKaro has no liability for refunds and will not issue refunds for matters beyond our direct control, including transactions between you and Advisors or third-party providers.

6. Claim Settlement

Claim settlement is the sole responsibility of the respective insurance or investment company, regulated by authorities such as IRDAI, SEBI, or RBI. All claim-related matters, including submission, processing, approval, or rejection, are handled directly between you and the third-party provider. NiveshKaro is not responsible for claim outcomes, whether approved, declined, or delayed, and shall not be liable to any party involved. While we may, at our discretion, assist in forwarding your claim query to the relevant provider, we do not guarantee resolution or intervention. To request assistance, contact us at support@niveshkaro.com with details of the claim and provider. NiveshKaro reserves the right to respond within 21 working days, extendable to 180 working days at our discretion.

7. No Guarantees or Warranties

NiveshKaro does not guarantee or warrant:

  • The accuracy, completeness, or reliability of any content or information provided on the Platform.
  • The availability, quality, or performance of Advisors or third-party providers.
  • The outcomes, returns, or suitability of any financial product or service.
  • The processing, approval, or timeliness of refunds or claims.

All content is for general informational purposes only and may not be current or accurate. You must conduct your own due diligence and assume all risks associated with your financial decisions, including refunds and claims.

8. Limitation of Liability

To the fullest extent permitted by law, NiveshKaro Parties shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, or financial losses, arising from: (i) use of the Platform; (ii) interactions with Advisors or third-party providers; (iii) reliance on Platform content; (iv) delays or refusals in refund processing; (v) claim settlement outcomes; or (vi) unauthorized access to your data. The Platform is provided "AS IS" without warranties of any kind, including merchantability, fitness for a particular purpose, or non-infringement. Total liability, if any, is capped at INR 1,000 (Rupees One Thousand Only). As an intermediary under Section 79 of the IT Act, NiveshKaro is not liable for third-party content or actions unless it has actual knowledge of illegality and fails to act expeditiously within stipulated timelines.

9. Indemnification

You agree to indemnify, defend, and hold harmless NiveshKaro Parties from any claims, losses, damages, liabilities, fines, penalties, or costs (including reasonable attorney fees) arising from: (i) your interactions or transactions with Advisors or third-party providers; (ii) violation of applicable laws; (iii) misuse of the Platform; or (iv) failure to follow this Advisory, including refund or claim-related disputes.

10. Modifications to Advisory

NiveshKaro reserves the right to modify or update this Advisory at any time, with changes effective upon posting on the Platform. You are responsible for reviewing updates periodically. Continued use of the Platform after changes constitutes acceptance of the revised Advisory.

11. Governing Law and Jurisdiction

This Advisory is governed by the laws of India, without regard to conflict of laws principles. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts in Thane, Maharashtra.
